General Types of Trusts in California
- Revocable Living Trust – Allows individuals to own and control their property while alive, then transfer it to the trustee after death, while avoiding probate.
- Irrevocable Trust – An agreement among a settlor, trustee, and beneficiaries that cannot be revoked or amended. The trustor cannot take back property they transfer to an irrevocable trust. An irrevocable trust allows the person who creates the trust to manage their assets while avoiding probate and providing asset protection from future creditors. A California irrevocable trust can also help reduce estate taxes for those subject to the federal estate tax. Irrevocable trusts also protect the deceased estate from the creditors of their beneficiaries.

What is a Trust?
A trust is a relationship whereby assets are held by one party and managed for the benefit of another. These assets may accumulate interest and are not a matter of public record; thereby maintaining privacy regarding the assets. Trusts have been around since the Roman era and have three parties associated with them: the trustor (the person putting assets into the trust), the trustee (the person managing the assets in the trust), and the beneficiary (the person benefiting from the assets in the trust). There may be multiple trustors, trustees, and/or beneficiaries.
